The rules of this website.

This site tells you what we do and gives you a way to reach us. Reading it doesn't make you a client, and nothing on it is advice for your particular situation. When we do work together, a separate written agreement covers it, and that agreement wins over anything here.

These terms are between you and Radworks Collective, a California business at 9856 Villa Pacific Dr, Huntington Beach, CA 92646. By using radworkscollective.com you're accepting them. If you don't accept them, please don't use the site.

It's a description of our practice and an invitation to get in touch. It isn't advisory, operational, financial, legal, tax, employment or human resources advice, and it isn't a substitute for any of those. Every business is different and general information can't account for yours.

Nothing here creates a client relationship or an engagement. We take on work through a written scope and a signed agreement, and until one exists on both sides, we're just talking.

When you fill in our form or open our live chat, you're asking us to get back to you, and you're giving us permission to do that by email or by phone using the details you gave. You can tell us to stop at any time and we will.

Please send us enough to have a useful first conversation and no more. Don't put anything genuinely confidential, privileged or regulated into a web form or a chat window: no health records, no social security or government identification numbers, no bank or card numbers, no login credentials, and nothing covered by somebody else's confidentiality agreement. Neither channel is the right place for it, and there is a better one once we're talking.

Tell us the truth about who you are. Don't send us somebody else's details as though they were yours, and don't sign up on behalf of a person who hasn't asked you to.

The chat window is run for us by another company, and conversations in it are stored in our customer record system. Treat it as a message you're sending us rather than a private aside. Replies may not be immediate, and at times you may be answered by an automated assistant before a person reads it.

How the information from it is handled is set out in our privacy policy.

If you give us your phone number on our form or in our chat, you're agreeing that we can get back to you about it. That's the whole permission you're giving: a reply to the thing you asked us about. Text messages are separate and you opt into them yourself, by ticking the box on our form, and we don't text you if you didn't. We won't add you to a marketing list, and agreeing to be contacted is never a condition of working with us.

How often we message you is simply how often the conversation needs it, and there's no campaign behind it. Message and data rates may apply depending on your mobile plan. Reply STOP to any message and it stops, permanently. Reply HELP and you'll get our contact details.

Our privacy policy sets out how your number is handled, and the short version is that we never sell it and never share it with anybody for their own marketing. If you'd rather we didn't call or text at all, say so and we'll use collaborate@radworkscollective.com instead.

Use the site for its purpose. Please don't do any of the following.

The text, design, code, layout and marks on this site belong to Radworks Collective or to the people we licensed them from, and are protected by copyright and trademark law. You're welcome to read the site, quote it with attribution and link to it. You're not licensed to republish it as your own.

The photography is a mix of our own pictures and freely licensed work, and every licensed image is credited on our photo credits page, which is part of these terms in the sense that the licences named there govern those images and not us.

If you send us an idea or a suggestion without our asking for it, we may act on it without owing you anything for it. That isn't us claiming your work: it's us being honest that we can't police unsolicited ideas against our own thinking. Anything you share with us under a signed agreement is governed by that agreement instead.

Where we link to somebody else, we're pointing, not vouching. We don't control those sites and we're not responsible for what's on them or what they do with your information once you're there.

The site is provided as it is. We work to keep it accurate, current and available, and we can't promise it always will be. To the fullest extent the law allows, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose and non infringement.

To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising out of your use of this site, even if we were told such damages were possible. Where liability can't be excluded, it's limited to one hundred United States dollars.

This section is about the website. It doesn't limit anything in a signed agreement between us, and it doesn't exclude any liability that can't lawfully be excluded.

If your use of the site breaks these terms and that causes a claim against us, you agree to cover the reasonable costs of dealing with it.

These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Any dispute belongs in the state or federal courts serving Orange County, California, and we each agree to those courts hearing it.

If part of these terms turns out to be unenforceable, the rest still stands.

We may update these terms. When we do, the date at the top changes, and using the site after that means you accept the new version. If a change matters, we won't be coy about it.
